These Terms of Use govern your access to and use of yourcarehome.co.uk and any related pages, features, forms, listings, reviews and content made available through the website (the Site).

yourcarehome.co.uk is operated by theMediaFlow Ltd, registered in England and Wales, company number 06769171. References in these Terms to we, us or our mean theMediaFlow Ltd.

By using the Site, you agree to these Terms of Use. If you do not agree, you must not use the Site.

1. About the Site

1.1 The Site is a UK information and comparison website relating to care homes, home care agencies and related care services.

1.2 The Site is intended to help users research and compare care providers and care-related options. We provide information in good faith to assist users with their own research.

1.3 We are not a care provider, medical provider, legal adviser, financial adviser or regulated care adviser unless we expressly say otherwise. We do not run, own or operate any care home or home care agency shown on the Site, and we are not a party to any care arrangement, contract or agreement you enter into with a provider.

1.4 Nothing on the Site amounts to medical advice, legal advice, financial advice, regulated care advice, or a recommendation that any particular provider, service or arrangement is suitable for any person.

1.5 You remain responsible for carrying out your own checks and making your own decisions. Important matters including fees, availability, suitability, registration status, inspection ratings, facilities, specialisms and contractual terms should always be verified directly with the relevant provider and, where appropriate, the relevant regulator or public authority.

1.6 Searching, comparing, saving listings and sending enquiries through the Site is free for people looking for care.

2. Information, listings and data sources

2.1 Information on the Site about individual care homes and home care agencies is built primarily from publicly available regulatory data published by the Care Quality Commission (England), the Care Inspectorate (Scotland), Care Inspectorate Wales, and the Regulation and Quality Improvement Authority (Northern Ireland), under the Open Government Licence where applicable. Other information on the Site may come from care providers, users, third-party sources and other materials we reasonably consider relevant.

2.2 We make every effort to keep the information on the Site accurate and current, including regularly refreshing the regulator data it is built from, but unless we expressly state otherwise, we do not independently verify all information published on the Site. Information can change at any time, and you are responsible for checking important details before relying on them.

2.3 We do not guarantee that any listing, description, photograph, fee information, room information, facility information, inspection summary, review, rating, availability information, contact detail or other content on the Site is complete, accurate, current or suitable for your purposes.

2.4 Providers are responsible for information they submit to us or ask us to publish on a listing they have claimed.

2.5 If we receive notice that information may be inaccurate, misleading, incomplete or out of date, we may investigate and may amend, remove, suspend or update the relevant content in our discretion.

2.6 Content on the Site is provided to help users carry out their own research and compare options. We are not responsible for how users interpret or rely on the information on the Site. Decisions about care should be made with the provider concerned and, where appropriate, relevant care, medical, legal or financial professionals.

2.7 A small number of listings on the Site are clearly labelled example listings, used to demonstrate what a paid listing looks like. Example listings are excluded from search results and from any listing counts on the Site.

2.8 All content on the Site is provided in good faith and for general information only. We publish it to help you research care options, and you should not treat it as the sole basis for any decision.

3. CQC and other regulatory information

3.1 The Site may display or refer to information from the Care Quality Commission, the Care Inspectorate, Care Inspectorate Wales, the Regulation and Quality Improvement Authority or other public bodies.

3.2 Such information remains subject to change by the original source, and users should check the relevant regulator directly for the latest official position.

3.3 Unless expressly stated, use of such information on the Site does not mean that the regulator endorses us or any provider shown on the Site.

4. Reviews, comments and user content

4.1 The Site may allow users to submit reviews, ratings, comments, survey responses, provider replies and other content (User Content).

4.2 By submitting User Content, you confirm that:

  • your content is truthful and based on a genuine experience or a comment you are lawfully entitled to make;
  • your content is not false, misleading, defamatory, abusive, threatening, discriminatory, obscene, unlawful or invasive of privacy;
  • your content does not include confidential or identifying information about residents, service users, staff or other individuals unless you are legally entitled to disclose it;
  • your content does not impersonate any person or misrepresent your relationship to a provider;
  • your content is not advertising or undisclosed promotion; and
  • your content does not infringe any third-party rights.

4.3 We may review, verify, moderate, refuse, remove, suspend, relabel or deprioritise User Content at any time, and may edit User Content other than reviews. Reviews are only ever edited as described in the Review and Comments Policy.

4.4 We may ask for information to help assess whether a review or comment appears genuine and relevant.

4.5 We do not guarantee publication, ranking, permanence or prominence of any review, rating, comment or provider reply. Reviews, comments and provider-supplied content reflect the views of the people who wrote them, not ours, and publication does not mean we endorse or have verified what they say.

4.6 Reviews and comments are also governed by our Review and Comments Policy, which forms part of these Terms. Where there is a conflict between these Terms and the Review and Comments Policy on a review-specific matter, the Review and Comments Policy applies.

5. Paid listings and advertising

5.1 Providers can claim their free listing and may choose to pay for an enhanced listing (a Paid Listing), which can include features such as premium placement, additional profile content, badges and other paid services.

5.2 Paid Listings appear ahead of free listings in search results and comparison pages. Featured or promoted placements are labelled as such.

5.3 Google AdSense advertising appears only on free listings. Paid Listings do not carry advertising or comparison modules.

5.4 Paid placement does not amount to a recommendation or endorsement by us. Paid services never change the regulator ratings or review content shown on a listing. See How we keep this service free for a full explanation of how the Site is funded.

5.5 Paid services for providers are governed by our Provider Terms, which apply in addition to these Terms.

6. Badges and embedded content

6.1 We may grant a provider a badge or award, for example recognising review performance or listing status. A provider may embed the badge artwork we supply on its own website.

6.2 Badge and award artwork remains our intellectual property. We grant a limited, revocable licence to display it for as long as the underlying status remains valid and we have not withdrawn the licence.

6.3 A badge must not be used, altered or displayed in a way that misrepresents a provider’s current status on the Site or suggests an endorsement by us that does not exist.

7. Acceptable use

7.1 You must use the Site only for lawful purposes.

7.2 You must not:

  • misuse the Site or interfere with its operation;
  • attempt unauthorised access to the Site, its systems or related infrastructure;
  • introduce malware or harmful code;
  • scrape, harvest, index, extract or reuse data from the Site on a bulk or systematic basis, including by bots or scripts, without our written consent;
  • copy, mirror or frame substantial parts of the Site; or
  • use the Site in any way that infringes another person’s rights.

8. Intellectual property

8.1 All intellectual property rights in the Site and its content, design, layout, branding, databases and software are owned by or licensed to us, except where otherwise stated.

8.2 You may view and print material from the Site for your personal, non-commercial use only.

8.3 You must not reproduce, republish, distribute, adapt, commercially exploit or create derivative works from the Site or its content without our prior written permission, except as permitted by law.

8.4 By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, publish, display, distribute, edit, adapt and use that content for operating, promoting, improving and protecting the Site and our business.

9. Third-party links and services

9.1 The Site may contain links to third-party websites, services or resources.

9.2 We provide links in good faith, but we do not control, verify or endorse third-party websites, services or content, and we are not responsible for their content, accuracy, availability, security or privacy practices. You access them at your own risk.

9.3 Inclusion of a link does not imply endorsement by us.

10. Accounts

10.1 The Site may offer accounts for care seekers, for example to save or bookmark listings and manage preferences, and accounts for providers, to claim, manage and pay for listings.

10.2 You are responsible for keeping your account credentials confidential and for activity that takes place under your account. Tell us promptly through our contact page if you believe your account has been accessed without your permission.

10.3 We may suspend or close an account where these Terms are breached, or where we reasonably consider it necessary to protect the Site, other users or providers.

10.4 If an account is created and never signed in to, we delete it after 7 days.

11. Availability

11.1 We do not guarantee that the Site, or any part of it, will always be available, uninterrupted, secure or free from errors, bugs or viruses.

11.2 We may suspend, withdraw, change or restrict all or part of the Site at any time.

12. Liability

12.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

12.2 To the fullest extent permitted by law, we exclude all implied terms, warranties, representations or other terms that may apply to the Site or its content.

12.3 To the fullest extent permitted by law, we are not liable for any loss or damage arising out of or in connection with:

  • use of, or inability to use, the Site;
  • reliance on any listing, review, rating, summary or other content on the Site;
  • any inaccuracy, omission, delay or out-of-date information;
  • any act, omission, misconduct, negligence, insolvency, service failure or regulatory issue of any care provider or other third party;
  • the content, availability, security or privacy practices of any third-party website or resource linked to from the Site; or
  • any indirect, consequential or business loss.

12.4 If you are a business user, you agree that we have no liability to you for loss of profit, revenue, business, contracts, anticipated savings, goodwill or opportunity.

12.5 If you are a consumer, nothing in these Terms affects your statutory rights.

13. Complaints and content notices

13.1 If you wish to report inaccurate content, unlawful content, privacy concerns or allegedly defamatory material, or if you have a complaint about the Site or our conduct, please contact us through our contact page.

13.2 We aim to acknowledge complaints within 14 days.

13.3 We may investigate complaints and may remove, restrict, edit or retain content while doing so.

13.4 To report content you believe is defamatory, give us the web address, the words complained of, why you say they are defamatory, and your contact details.

14. Changes to these Terms

14.1 We may amend these Terms of Use from time to time.

14.2 The latest version published on the Site will apply from the date of publication.

15. Governing law

15.1 These Terms of Use are governed by the laws of England and Wales.

15.2 If you are a consumer, you may bring proceedings in your part of the United Kingdom where applicable law allows this.

15.3 If you are a business, the courts of England and Wales shall have exclusive jurisdiction.
